RALLY SOCIAL
PARTICIPANT AGREEMENT, ASSUMPTION OF RISK, RELEASE OF LIABILITY, AND TERMS OF SERVICE
Effective Date: August 1, 2026
This Participant Agreement, Assumption of Risk, Release of Liability, and Terms of Service ("Agreement") is entered into between Rally Social ("Rally Social," "Company," "Facility," "we," "our," or "us") and the undersigned individual.
For purposes of this Agreement, the term "Participant" includes and refers to any player, customer, member, guest, spectator, visitor, coach, instructor, volunteer, parent or legal guardian of a minor participant, or any other person who enters, visits, books, purchases, accesses, or uses Rally Social's premises, facilities, equipment, programs, products, or services, whether participating in pickleball activities or not.
Throughout this Agreement, the term "Participant" shall have the meaning set forth above.
By entering the Facility, making a reservation, purchasing any product or service, attending lessons, clinics, leagues, tournaments, camps, private coaching sessions, special events, or otherwise accessing or using Rally Social's premises or services, the Participant acknowledges that they have read, understood, and voluntarily agree to be legally bound by this Agreement.
1. ASSUMPTION OF RISK
The Participant understands that pickleball and all related recreational, instructional, athletic, social, and fitness activities involve inherent and unavoidable risks that may result in serious injury, permanent disability, illness, property damage, or death.
These risks include, but are not limited to:

Slipping, tripping, or falling

Collisions with other persons

Contact with paddles, balls, nets, fencing, walls, furniture, or equipment

Muscle strains and tears
-
Sprains
-
Fractures
-
Cuts and bruises
-
Eye injuries
-
Concussions
-
Heart attack
-
Stroke
-
Heat exhaustion or dehydration
-
Medical emergencies
-
Permanent disability
-
Death
The Participant voluntarily assumes all known and unknown risks associated with entering, using, or participating in any activity at Rally Social.
2. RELEASE OF LIABILITY
To the fullest extent permitted by applicable law, the Participant hereby releases, waives, discharges, and covenants not to sue Rally Social or any of its:

Members

Employees
-
Coaches
-
Trainers
-
Instructors
-
Volunteers
-
Independent Contractors
-
Sponsors

Vendors

Event Organizers

Landlords

Property Owners

Affiliates
-
Agents
-
Successors
-
Assigns
from any and all claims, demands, liabilities, damages, causes of action, lawsuits, costs, expenses, attorney's fees, or judgments arising out of or related to:

Personal injury
-
Illness
-
Emotional distress
-
Property damage
-
Economic loss
-
Wrongful death
-
Loss of use
-
Theft
-
Any other damages arising from participation or presence at Rally Social.
This release applies regardless of whether such claims arise from ordinary negligence, premises conditions, equipment failure, acts of other participants, or any other cause, except where prohibited by applicable law or resulting from gross negligence or willful misconduct.
3. MEDICAL AUTHORIZATION
If the Participant becomes injured or incapacitated, Rally Social may obtain emergency medical care deemed reasonably necessary.
The Participant authorizes emergency medical treatment and understands that Rally Social has no obligation to provide medical care.
The Participant accepts full responsibility for all medical expenses, ambulance fees, hospital charges, physician services, rehabilitation costs, prescriptions, and any related expenses.
4. PHYSICAL CONDITION
The Participant represents that they are physically capable of participating in the activities offered by Rally Social.
The Participant understands that it is their responsibility to consult a physician before engaging in strenuous physical activity.
The Participant agrees not to participate while suffering from any condition that may endanger themselves or others.
5. PERSONAL PROPERTY
The Participant is solely responsible for all personal property brought onto Rally Social premises.
Rally Social shall not be liable for any:

Lost property

Stolen property
-
Damaged property
-
Misplaced items
including but not limited to paddles, bags, clothing, jewelry, electronics, wallets, keys, cash, or vehicles.
6. FACILITY RULES
The Participant agrees to comply with all:

Posted rules
-
Safety policies
-
Staff instructions
-
Court procedures
-
Membership policies
-
Reservation policies
The Participant shall:

Wear appropriate non-marking athletic footwear.
-
Conduct themselves respectfully.
-
Use equipment only as intended.
-
Report unsafe conditions immediately.
-
Exercise reasonable care while using the Facility.
Rally Social reserves the right to deny entry, suspend privileges, or remove any Participant for violating Facility rules without refund.
7. DAMAGE TO PROPERTY
The Participant agrees to be financially responsible for any damage to Rally Social property caused intentionally, recklessly, or through misuse.
8. MEMBERSHIPS, BOOKINGS, AND PAYMENTS
Court reservations, memberships, lessons, clinics, leagues, and events are subject to availability.
Rally Social reserves the right to:

Cancel reservations

Modify schedules
-
Close courts
-
Reschedule events
-
Refuse service
-
Limit participation
Refunds, cancellations, credits, and rescheduling shall be governed by Rally Social's posted policies in effect at the time of the reservation.
9. CODE OF CONDUCT
The Participant agrees to conduct themselves in a respectful and sportsmanlike manner.
Prohibited conduct includes but is not limited to:

Fighting
-
Harassment
-
Discrimination
-
Threatening behavior
-
Verbal abuse
-
Physical abuse
-
Intoxication
-
Illegal drug use
-
Smoking or vaping where prohibited

Vandalism
-
Theft
-
Cheating
-
Unsafe play
Violation may result in immediate removal, suspension, or permanent revocation of privileges without refund.
10. PHOTO AND VIDEO RELEASE
The Participant grants Rally Social permission to photograph, record, livestream, or otherwise capture the Participant's image, voice, or likeness while on Rally Social premises.
Such photographs or recordings may be used without compensation for:

Marketing
-
Advertising
-
Social media
-
Website
-
Promotional materials
-
Educational content
-
Public relations
The Participant waives any right to inspect or approve the finished materials.
11. ALCOHOL AND DRUGS
Participants shall not participate while impaired by alcohol, illegal drugs, or any substance that may affect safe participation.
Rally Social reserves the right to refuse admission or remove any Participant appearing impaired.
12. HEALTH AND COMMUNICABLE ILLNESS
The Participant agrees not to enter the Facility if experiencing symptoms of a contagious illness, including fever, vomiting, diarrhea, or any condition that could reasonably endanger others.
13. INDEMNIFICATION
The Participant agrees to defend, indemnify, and hold harmless Rally Social from any claims, demands, damages, liabilities, judgments, costs, or attorney's fees arising from the Participant's actions, negligence, misconduct, violation of this Agreement, or injury caused to any third party, to the fullest extent permitted by law.
14. MINORS
A parent or legal guardian must execute this Agreement on behalf of any Participant under eighteen (18) years of age.
The parent or legal guardian accepts all risks and responsibilities on behalf of the minor and agrees to be bound by this Agreement.
15. TERMINATION OF PRIVILEGES
Rally Social reserves the right, in its sole discretion, to suspend or permanently terminate any membership, reservation, or Facility privileges for violations of this Agreement or conduct deemed unsafe or detrimental to the Facility or its patrons.
16. GOVERNING LAW
This Agreement shall be governed by and interpreted in accordance with the laws of the jurisdiction in which the applicable Rally Social Facility is located, without regard to conflict-of-law principles.
Any dispute arising from this Agreement shall be brought exclusively in a court of competent jurisdiction located within that jurisdiction, unless applicable law provides otherwise.
17. SEVERABILITY
If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
18. ENTIRE AGREEMENT
This Agreement constitutes the entire understanding between Rally Social and the Participant concerning the subject matter herein and supersedes all prior oral or written agreements.
No modification shall be effective unless made in writing by Rally Social.
19. ELECTRONIC SIGNATURES
The Participant agrees that electronic acceptance, online checkboxes, digital signatures, and electronic records shall have the same legal effect as original handwritten signatures to the fullest extent permitted by law.
20. ACKNOWLEDGMENT
By signing below, the Participant acknowledges that:

They voluntarily agree to all terms contained herein.
